Sales terms and conditions
Please read carefully these terms and conditions of
sale, ‘’sale agreement’’.
The customer agrees to this sale agreement and all
its terms and conditions, unless he has signed a
separate agreement with Solo Italiano. In that case
the separate agreement shall govern.
Important information about this legal contract
This agreement constitutes a legal contract between the customer an Solo
Italiano and by shopping, or placing an order on the Site, the customer
automatically accepts this sale agreement. With ‘‘you’‘ and ‘‘your’‘ we refer to
the Customer; with ‘‘Solo Italiano’‘ we refer to Solo Italiano. These terms and
conditions are subject to change without notice, but the terms and conditions
initially placed by the Customer will govern.
This Sale Agreement constitutes the entire agreement between the Customer and
Solo Italiano relating to the purchase of goods or services in this Site. This
sale agreement may be modified of terminated with a written statement signed by
Solo Italiano. Electronic records, or electronic signatures are accepted under
this Sale Agreement. The customer agrees to receive electronic records via a web
browser or via e-mail. If the Customer wants to receive electronic records or in
case he/she provides the record in a non-electronic form, he/she might contact
Solo Italiano at the address provided below.
In case of conflict between the terms and conditions stated on your order and
this sale agreement or between the terms on your invoice, please remember that
the provisions on this Agreement and on our invoice shall control.
Governing law
This agreement and any sales hereunder are governed by the Italian law without
regard to law conflicts. The customer consents to the jurisdiction of the
Italian law; in case of dispute, the court having jurisdiction is the court of
Modena Italy.
Title, loss.
The goods herein purchased are property of the seller until they are paid by the
purchaser.
Loss or damage that occurs during shipping by a carrier selected by Solo
Italiano is Solo Italiano's sole responsibility.
Export sales.
If the Customer buys goods for the purpose of exporting them, he/she must obtain
from the Government the documentation to export goods in a foreign country.
Please remember that manufacturers' warranties may vary or be null in case of
goods exported outside Italy. The Customer should inquire further. Any liability
is only for purchased products.
General legal disclaimer.
Solo Italiano declines all responsibility for all warranties expressed or
implied including but not limited to merchantability or fitness for a particular
purpose. The manufacturers' warranties, if any, are not affected by this
disclaimer.
Internet disclaimer.
Internet connectivity requires access from an internet provider. Contact your
local provider for rates, terms and conditions.
Prices and information disclaimer.
All prices are subject to change. Due to changing market conditions, product
discontinuation and price changes, errors in advertising, Solo Italiano reserves
the right to make changes to the prices.
Solo Italiano makes reasonable efforts to keep the Site constantly up-to-date
but we don't guarantee for the Site's accuracy and we assume no responsibility
for any errors in the contents of the Site.
Limitation of liability.
SOLO ITALIANO IS NOT RESPONSIBLE FOR LOSS OF PROFITS, BUSINESS OR ANY OTHER
CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY A THIRD PARTY.
Shipping
Product prices do not include shipping costs, which will be reckoned, after your registration, at the end of purchasing procedure.
Shipping below 60 kg are carried out via express courier, while for higher weights wares can be shipped also via freighter (door to airport), this minimum weight requirement is due to cargo fixed costs, that make low weight shipping extremely expensive.
Orders; Terms of payment.
Orders are not binding upon Solo Italiano until they are accepted by Solo
Italiano. An order is considered as accepted when it is charged on the credit
card or, in case of bank transfer, when bank checks turn out to be positive.
Terms of payment are at the sole discretion of Solo Italiano. Invoices are due
and payable within the time written on the invoice, measured from the date on
the invoice.

Shipping.
Shipping charges of the orders can vary; you are kindly requested to see the
page ‘’Payment Method’’ placed in the password protected area for shipping rates
and options.
Returns

The
Customer has the right to return merchandise for unspecified reasons within
10 (ten) days from the delivery. The goods have to be sent back INTACT to
our address Solo Italiano accepts return goods only in case they are
transported into refrigerated boxes where temperature remains between 0 and
4°C for a suitable conservation of the products themselves.

Please

for returned merchandise. No returns will be accepted without this number.
For faster service, please remember to have the following information when
you call: customer name, invoice number, serial number and nature of the
problem.

All
returns must be complete, including all the original boxes and packing with
all accessories and documentation provided. As concerns perishable goods,
Solo Italiano accepts return goods only in case they are transported into
refrigerated boxes where temperature remains between 0 and 4°C for a
suitable conservation of the products themselves.

You are
responsible for shipping charges on returned items; Solo Italiano will match
your shipping method on your replaced or exchanged items.

Solo
Italiano suggests you to insure your return shipment in case it is lost or
damaged and use a carrier that provides you with proof of delivery.

In case of
damaged goods, you should REFUSE it directly to the carrier. If you accept
the package make sure it is noted on the carrier's delivery record so that
Solo Italiano can file a damage claim. If you do not notify Solo Italiano
immediately for damaged merchandise within 7 (seven) days our regular return
policy will govern.

In case of
DEFECTIVE returns, you can send it directly to Solo Italiano within 7 days
from the invoice date at the discretion of Solo Italiano the replacement of
product substitution or credit.

NON-DEFECTIVE returns are accepted by Solo Italiano within 7 days from the
invoice date at the discretion of Solo Italiano for product substitution or
credit.
Solo Italiano
reserves the right to accept returns beyond 7 days from the invoice date. If the
product is accepted after 7 days the credit will be valid for future purchases
only. Original shipping charges are not refunded for returned items, while Solo
Italiano will pay the shipping charges on the replacement.
Credit cards.
Solo Italiano does not apply any surcharge for payments with credit cards. |
